The extent of secondary legislation that may be needed under the Bill has recently been the subject of a report by the House of Lords Select Committee on the Constitution. The Committee put this as being a difference between “the more mechanical act of converting EU law into UK law, and the discretionary process of amending EU law to implement new policies in areas that previously lay within the EU’s competence”, which the Committee thought should be done through primary legislation. ⁹ While there is inevitably a degree of discretion in how to undertake even the first of these categories, the Government agrees that the purpose of the Great Repeal Bill and the secondary legislation is to convert EU law into UK law.
