Definition
(1) Any person who publicly degrades the Turkish flag by tearing, burning it or similar action
shall be sentenced to a penalty of imprisonment for a term of one to three years. This
provision is applicable to any insignia which bears the white crescent and star on a red
background, as defined in the Constitution, which is used as a symbol of the
sovereignty of the State of the Republic of Turkey.
(2) Any person who publicly degrades the National Anthem shall be sentenced to a penalty
of imprisonment for a term of six months to two years.
(3) Where the offence defined in this article is committed by a Turkish citizen in a foreign
country, the penalty shall be increased by one-third.
