Definition
(1) In order to constitute a jointly committed offence it is sufficient that the act is unlawful and
committed intentionally. Each person participating in the commission of an offence shall be
sentenced according to his unlawful act, irrespective of the individual circumstances of another
which may prevent the imposition of a penalty.
(2) For specific offences, only the person possessing the proscribed qualifications required for such
offence may be defined as the offender. Other persons who are involved in the commission of
these offences shall remain culpable for incitement or assistance.
(3) In order to be culpable for a jointly committed offence, there must have been, at least, an attempt to
commit the offence.
